1. Acceptance of Terms

By downloading, installing, or using TimedSketch ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

TimedSketch is a mobile application designed to help users practice drawing skills through timed drawing sessions with reference images.

3. User Accounts

You may be required to create an account to access certain features of the App. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. User Content

4.1 Your Content

You retain ownership of any content you create, upload, or share through the App, including:

  • Your drawings and sketches
  • Custom track images
  • Profile information

4.2 License Grant

By uploading content to the App, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of providing the App's services.

4.3 Content Guidelines

You agree not to upload or share content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains explicit, offensive, or inappropriate material
  • Harasses, threatens, or harms others

5. Community Features

When sharing custom tracks or other content with the community, you acknowledge that:

  • Shared content becomes visible to other users
  • You have the right to share all images in your custom tracks
  • We reserve the right to remove content that violates these terms

6. Prohibited Activities

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any illegal purposes
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Upload malicious code or viruses

7. Subscription and Payments

7.1 Premium Features

TimedSketch offers premium features through two purchase options:

  • Lifetime Purchase: One-time payment for permanent access to all premium features
  • Monthly Subscription: Auto-renewable monthly subscription for access to all premium features

7.2 Pricing and Payment

  • Pricing is displayed in the App and in your local currency through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • You agree to pay all applicable fees and taxes

7.3 Auto-Renewable Subscriptions

If you purchase a monthly subscription:

  • Subscription automatically renews each month unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • The renewal cost will be the same as the initial subscription price unless you are notified otherwise
  • Subscriptions may be managed and auto-renewal may be turned off by going to your Apple App Store Account Settings after purchase

7.4 Cancellation

  • You may cancel your subscription at any time through your Apple App Store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds will be provided for the unused portion of any subscription period

7.5 Refunds

  • All purchases are processed through the Apple App Store
  • Refund requests must be made directly through Apple
  • Refunds are subject to Apple's refund policies and are at Apple's sole discretion
  • We do not have access to your payment information or the ability to process refunds directly

8. Intellectual Property

The App, including its original content, features, and functionality, is owned by TimedSketch and is protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at our discretion, including for:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Prolonged inactivity

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, TimedSketch shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new terms.
